The general terms and conditions below (the "Terms") apply to all services (hereinafter referred to as "Services" or individually "Service") provided by Frenf.it (hereinafter "Frenf.it" or "Frenfit" or "owner"). The user of the Services (hereinafter "User" or "Users"), which register or use any of the Services, must accept the Terms and Conditions, which will also be applicable to all Services that will be provided to Users in the future, unless it is otherwise requested during the registration or the first delivery of the new service. Some of the services regulated by the Terms, in fact, are also subject to particular terms and conditions ("Special Conditions") because of their nature and/or their features. Such Special Conditions will be communicated to the Users in accordance to the procedures exposed in Article 2. The General Conditions and Special Conditions (hereinafter, collectively, the "Terms of Agreement" or "Agreement") are subject to Legislative Decree 22.5.1999 n. 185 of Italian Civil Codex for the protection of consumers signing distance contracts, taking into account the gratuity of services, except for the cost of installation and/or phone or data connection ti the Internet, which are sole responsibility of the User. The user has the right to terminate the contract without penalty within 10 working days from the day of registration, by sending the notice prescribed in Article 2.
To register or use the Services you must fill out the form that appears on screen at the time of registration: Frenf.it requires Users to provide some personal information. The processing of such data is done according to the privacy policy, which is exposed in the registration process. With the acceptance of the Agreement, you represent that your personal details are up to date, correct and true. The User also agrees to update any data recorded so they are constantly updated, complete and truthful. Frenf.it may, at any time and without notice, suspend or terminate the Services. In particular, Frenf.it may interrupt the Services with immediate effect and without prior notice, in the following cases:
1) When the user does not provide up to date, complete and truthful information for personal identification.
2) When the user makes use of the services for illegal purposes or for the transmission or exchange of material that is unlawful, harassing, racist, libelous or defamatory, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable or violates, or may violate, intellectual or industrial property rights or other rights of third parties; which causes annoyance, disturbance or damage in any way, to minors (violence, child abuse, exploitation, etc.).
3) When the user makes use of the services for the transmission or exchange of viruses, chain letters, or unwanted distribution and mass email.
4) When the user violates the General Conditions or the Special Conditions applicable to a Service.
The User expressly authorizes Frenf.it to send any Special Conditions and any subsequent amendments to his/her email address, if provided, also through a link to the relevant webpages of the Service. Continued use of even one Service by the User will be a confirmation of its willingness to adhere to the General Conditions, the Special Conditions and any subsequent change. The Services are provided indefinitely, subject to the right of Frenf.it to suspend or terminate the Services with reasonable notice and without any liability to the Users, which in turn may at any time terminate the Contract, according the procedures indicated in the section "User Account Deletion" or even by sending a request via email to the address frenfit@gmail.com. Frenf.it reserves the right to change from time to time the General Conditions or the Special Conditions, upon notice to users via a message displayed on the screen before the next use of any of the Services. In case he doesn't agree to these new conditions, the User has the right to terminate the Agreement, as specified in the preceding paragraph.
The User is responsible for maintaining the confidentiality of the access credentials. In addition, the User assumes the sole responsibility for all its activities within the Services and agree to indemnify and hold harmless the provider from any claim, demand or threat relating to or arising from the use or abuse of his participation in the Services. The user agrees to immediately notify the supplier to the email address frenfit@gmail.com any unauthorized use of his username and/or password or any other breach of security of which he become aware of. The User can change the password by asking at the same address: frenfit@gmail.com.
Your right to use the Services is personal and not transferable. You can only be a natural person and can not therefore be a legal person, entity or other organization, even without legal personality. Users may not resell or make any commercial use of the Services, without the written consent of the provider.
Frenf.it or Users may provide links to other sites or other Internet resources. The User acknowledges and agrees that Frenf.it is not liable or responsible for the operation of such external sites or resources. Frenf.it is not required to verify the links and does not control the content of such sites and assumes no responsibility for the content and/or material, including advertising, on such sites or resources or regarding the products or services offered therein. Such products or services can not be considered in any way sponsored, approved or supported by the Owner and therefore the User assumes all liability for any eventual purchases made of such products or services.
User specifically acknowledges that all intellectual property rights, protected under the rules relating to copyright law (Title IX of Book V of the Italian Civil Code, Art. 2575 to 2594 cc, as well as Law no. 633/1941, as amended by Legislative Decree. No. 169/1999) or other provisions, including, for example, knowhow, source code, software, hardware, projects, applications, patents, trade secrets, formulas, algorithms, models, databases and the like, related to the Services and other materials from Frenf.it or otherwise made available to the User by the Owner under the Contract remain the exclusive property of Frenf.it, which grants all User 'personal, nontransferable and nonexclusive license to use the Services on a single computer in accordance with the Conditions of Contract. In any case, the user may not copy, modify, sell, assign, sublicense, grant or transfer to third parties, or create derivative works from any of the rights of the owner, or allow third parties to do so by either you or his computer, even without his knowledge. If the User makes available to the holder materials or publications he holds intellectual property rights upon, for distribution using Frenf.it, the holder shall be deemed authorized to the economic exploitation of the rights connected to said publication or distribution, without any compensation to the User, given the moral right to be recognized as the author.
The User acknowledge that the use of the Services is at his own risk. The Services are provided "as is" and "as available". Frenf.it offers no guarantee that the Services correspond to the requirements of the User, or that will be uninterrupted, secure or error free; Frenf.it also offers no guarantee that the results will be as expected or desired.
The owner discharge any liability for any claims by the User concerning the inability to use the Services, for any reason. The owner is not liable for any damages, claims or losses, direct or indirect, caused to the user for failure and / or malfunctioning of the User or third parties electronic devices, including Internet Service Providers, telephone and / or telecommunication not directly managed by Frenf.it or by persons for which it is responsible. Frenf.it shall not be held responsible for lack of fulfilling its obligations, nor liable for damages arising from failure due to malfunctioning of the electronic means of communication for reasons outside the sphere of the Owner's control, including, for example, fires, natural disasters, lack of energy, lack of telephone lines or failure of other suppliers of network services, malfunctioning of computers and other electronic devices, malfunction of software installed by the User as well as actions of other users or other persons with access to the network.
You agree to use the Services only for lawful purposes as allowed by current applicable laws, usages and customs, rules of diligence. In any case, without infringing the rights of any third party, using or not the Service, and paying particular attention to the rules of data protection, laws on the protection of intellectual and industrial property and laws on telecommunications. The User assume full responsibility for the content of messages and texts sent by his or her name to a third party through the Services, accepting full responsibility and raising Frenf.it, and the persons related to it or under its control, its representatives, employees or any partners from any claim for consequential damages or compensation and reimbursing the owner of all costs arising from claims or actions by third parties for damages caused by you or any person authorized by you to access the Services.
Special Conditions apply to the following services.
The "Community Services" are the services offered by Frenf.it to the community of users, and include, without limitation, private messages, mailboxes, and personal pages. The Community Services are subject to the following Special Conditions:
Frenf.it acts as a provider of virtual spaces in which the Community Services are offered. Frenf.it makes no supervision or control over the content of the comments or messages conveyed in the network by the users through the Community Services and therefore disclaims any responsibility in this regard. Even if any of the Community Services provides the figure of a "Webmaster", the latter will limit itself to organize the flow of messages sent by users, without previous control on the content of comments and messages.
Frenf.it is not required to perform any control activities regarding compliance with the law, editing, or to ascertain the truth, on the merits and not misleading nature of the information provided, nor to carry out investigations on the specific contents of the reports and / or the message conveyed through the Services. In all cases, the user will not be given any right to challenge the decisions of Frenf.it or to be indemnified or compensated by anyone. In addition, the user will be required to indemnify and hold Frenf.it harmless from any claim made to him by third parties.
Frenf.it is NOT LIABLE FOR THE TREATMENT OF ANY PERSONAL DATA CONTAINED IN USER MESSAGES AND HOSTED BY IT, AND MAKES NO WARRANTY OR GUARANTEE ABOUT THE ACCURACY, CURRENTNESS OR COMPLETENESS OF THIS INFORMATION.
You assume full responsibility for the content of the information and texts sent to Frenf.it, accepting full ownership and responsability and lifting Frenf.it from any claim for consequential damages or compensation, and reimbursing Frenf.it of all costs arising from claims or actions of third parties based on infringement of intellectual property rights of third parties or acts of unfair competition made by you through the Services. The Owner CANNOT BE HELD RESPONSIBLE FOR THE CONTENT OF REPORTS MADE BY THE USERS AND HOSTED BY Frenf.it , AND MAKES NO WARRANTY OR GUARANTEE ABOUT THE LAWFULNESS, CORRECTNESS, COMPLETENESS, RELIABILITY, ACCURACY OR UTILITY OF THE INFORMATION PROVIDED THROUGH THE SERVICE.
By using the Community Services, Users are required to abide by the rules of"netiquette" (good manners on the Net) including, but not limited to:
- use the Community Services for lawful purposes, always using tones and expressions that conform to the rules of civil coexistence;
- Do not use the Community Services for commercial or advertising purposes;
- Do not use the Community Services to threaten or harass other participants, to spread messages that are obscene, libelous, invasive of another's reputation or otherwise contrary to public policy or morality or likely to cause harm or offense to other participants or third parties;
- Do not use the Community Services to spread content protected by intellectual property rights of third parties without the owner's permission;
- Do not use the Community Services to spread information that is confidential or damaging of another's privacy;
- Respect the age limit required for use of the selected Service;
- Respect and follow group's interest topic and refrain from disseminating inappropriate material within the Services.
The violation of the Rules of Netiquette indicated in paragraph d) may be reported to Frenf.it, which is authorized to remove the offending material and to undertake the measures quoted in Article 1 of the General Conditions or any legal measure the Owner deems necessary.
The User of Frenf.it is considered the author, owner and sole responsible for the content he publishes through the Services offered by Frenf.it, whether privately or in public. If the User wish to terminate the contract, he/she may do it by using the procedure described in the user guide or by express request to Frenf.it.
Frenf.it provides access to certain parts of its website and to some services linked to it via RSS feeds and a number of public APIs. The use of such resources constitutes acceptance of the terms and conditions listed herein. Frenf.it also requires a fair use of such resources as described in this document. Frenf.it reserves, lastly, the right to modify these features and disable access to the RSS feeds or API at any time and for any reason.
